Motion Index — Terms of Service

1. What These Terms Cover
These Terms of Service ("Terms") are a legal agreement between you and Motion Index ("we," "us," "our"), operated from Norway. They govern your access to and use of the Motion Index platform at motionindex.io, including all features, tools, content, and services (the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 16 years old to create an account or use the Service. By agreeing to these Terms, you confirm that you meet this age requirement.
2. What Motion Index Is
Motion Index is a search engine for product films. It is a curated, searchable video reference library and creative workspace built for professionals who create, commission, or direct product-focused video content — including motion designers, filmmakers, creative directors, agencies, and studios.
The Service provides:
- A curated, searchable library of product film references sourced from publicly available content on YouTube and Vimeo
- Reduced-resolution thumbnail images that serve as visual navigation aids for finding and identifying video content within the library
- Embedded video playback via official YouTube and Vimeo iframe embeds
- Visual, semantic, and keyword-based search tools with advanced taxonomy and color filtering — enabling users to find the right reference in seconds rather than hours
- A collaborator network mapping the professional relationships between brands, agencies, studios, and individuals across the indexed library
- A canvas workspace where users can spatially arrange references and their own uploaded content for moodboarding and pre-production
- Collections for organizing and bookmarking reference material
- Collaboration features for working with team members on shared projects
Motion Index is a search and discovery tool. It does not host or stream video content. All video playback occurs through the originating platform's official embed player, and views are attributed to the original creator.
3. Accounts
3.1 — Registration
To access the Service, you must create an account by providing a valid email address and password (minimum 8 characters), or by authenticating through a supported provider (Google or Apple). You must verify your email address before your account is fully activated.
You are responsible for maintaining the security of your account credentials. Do not share your login with others. You are responsible for all activity under your account.
3.2 — Accuracy
You agree to provide accurate information when creating your account and to keep it up to date. We reserve the right to suspend or terminate accounts that use false or misleading information.
3.3 — Device Sessions
You may access the Service from multiple devices, up to a maximum of 3 concurrent devices per user. You can view and revoke active sessions at any time through your account settings.
3.4 — One Account Per Person
Each account is for a single individual. Sharing account credentials with others is not permitted. Team and Enterprise plans provide multi-user access through proper team subscriptions.
4. Access Levels, Subscriptions, and Payments
4.1 — Public Access (No Account)
The Motion Index library is publicly browsable. Visitors without an account can scroll the curated gallery and view individual video pages (including thumbnails and embeds) via direct links. Public access does not include search tools, filtering, collections, the canvas workspace, the collaborator network, or any other platform features.
4.2 — Plans
Motion Index offers three levels of paid access:

Pro is for individual professionals. One account, full access to the platform, up to 3 devices.
Team is for studios, agencies, and creative teams. Up to 10 users, each with their own account and 3 devices. Includes shared team collections and collaborative canvas projects. One team subscription covers all users — no per-seat management required.
Enterprise is for larger organisations requiring more than 10 users. Pricing is determined through conversation based on team size and requirements. Contact us at [contact@motionindex.io] for Enterprise inquiries.
We reserve the right to modify pricing or plan features with 30 days' notice to existing subscribers. Changes will take effect at the start of your next billing cycle. Early subscribers may be eligible for grandfathered pricing at the discretion of Motion Index.
4.3 — Free Trial
New users may start a 14-day free trial of the Pro plan with full access to all features. A valid payment method is required to start a trial. You will receive a reminder 3 days before your trial expires. If you do not cancel before the trial ends, your payment method will be charged automatically at the Pro plan rate.
You may cancel at any time during the trial without being charged.
4.4 — Payment
All payments are processed by Stripe. We accept credit and debit cards (Visa, Mastercard, American Express, Discover), Apple Pay, and Google Pay. Enterprise customers may pay by invoice or purchase order.
Paid subscriptions renew automatically at the end of each billing cycle (monthly or annually) unless cancelled before the renewal date. You can manage your subscription, update payment methods, and view invoices through your account settings.
All prices are in US dollars unless otherwise stated. You are responsible for any applicable taxes in your jurisdiction.
4.5 — Refunds
- Monthly subscriptions: Refunds are available within 3 days of being charged.
- Annual subscriptions: Refunds are available within 30 days of being charged.
- EU/EEA and UK customers: In accordance with consumer protection law, you have the right to cancel within 14 days of purchase for a full refund, regardless of plan type.

4.6 — Cancellation
You may cancel your subscription at any time. Upon cancellation, you retain access to paid features until the end of your current billing period. After that, your account loses access to search tools, collections, canvas, collaborator network, and other paid features. Your data (collections, projects, uploads) is retained for 90 days in case you resubscribe. After 90 days, inactive account data may be deleted.
For Team plans, cancellation affects all users on the team. The team administrator is responsible for notifying team members before cancelling.
4.7 — Device Limits
Each user may access the Service on up to 3 concurrent devices. Each device is identified by its browser/device combination. If you reach your device limit, you will be prompted to log out of an existing device before signing in on a new one. You can manage your active sessions at any time through your account settings.
5. How We Present Third-Party Content
5.1 — Video Embeds
Motion Index embeds publicly available videos from YouTube and Vimeo using standard iframe embed functionality provided by those platforms. Video playback is served by and subject to the terms of the originating platform. We do not host, store, or re-stream video content.
5.2 — Thumbnail Images
To make the library searchable and useful as a professional reference tool, Motion Index displays reduced-resolution thumbnail images derived from publicly available video content. These thumbnails function as visual navigation aids — comparable to thumbnails in a search engine — that help users identify, find, and reference specific content within the library.
Thumbnails are publicly accessible on individual video pages. Clicking or interacting with a thumbnail leads to playback of the original video through its official embed. Thumbnails exist to point users toward the original work, not to replace or substitute it.
5.3 — Metadata, Taxonomy, and Collaborator Network
Motion Index generates and maintains editorial metadata for indexed content, including shot size, pacing, style, camera movement, color analysis, and creator attribution. Motion Index also maps the professional relationships between brands, agencies, studios, and individuals across the indexed library, creating a collaborator network that reveals working relationships within the motion design industry. This metadata and network data is the intellectual property of Motion Index.
6. Intellectual Property
6.1 — What Motion Index Owns
Motion Index owns or licenses:
- The platform's design, code, user interface, and overall presentation
- All search algorithms, indexing systems, and discovery tools
- All editorial curation, metadata, taxonomy, tagging systems, and organisational structures
- The collaborator network data, including mapped relationships between brands, agencies, studios, and individuals
- The Motion Index name, brand, logo, and associated trademarks
6.2 — What Motion Index Does Not Own
Motion Index does not claim ownership of:
- The underlying video content embedded from third-party platforms
- The creative works, trademarks, or intellectual property of any studio, agency, freelancer, or individual whose work appears in the library
6.3 — Nature of Thumbnails
Thumbnail images displayed within the Service are reduced-resolution reference images that function as navigational aids within a professional search and discovery tool. They are not sold, licensed, or made available as standalone assets. Their purpose is to index and identify the original work, which remains on its originating platform.
6.4 — Your Content
You retain full ownership of any content you upload to the Service, including files added to collections and content created within the canvas workspace. By uploading content, you grant Motion Index a limited, non-exclusive license to host, store, display, and transmit that content as necessary to operate the Service and provide its features (including collaboration and sharing features you choose to use).
This license terminates when you delete your content or your account, except where the content has been shared with other users who have not deleted their copies, or where retention is required by law.
7. Acceptable Use
7.1 — Personal and Professional Reference
The Service is intended for professional reference, study, inspiration, and creative pre-production work. You may browse the library, search for content, save references to collections, and use the canvas workspace for moodboarding and project planning.
7.2 — What You May Not Do
You may not:
- Download, scrape, crawl, or otherwise extract library thumbnail images from the Service for use outside of it
- Use any automated tool, bot, script, or scraper to bulk-access or extract content from the Service
- Redistribute, republish, or share Motion Index library thumbnails outside the platform through any means
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Use the Service for any unlawful purpose or in violation of any applicable law
- Resell, sublicense, or commercially exploit access to the Service beyond the scope of your subscription
- Share your account credentials with others or allow others to access the Service through your account
- Circumvent any access controls, authentication mechanisms, or usage limits
- Use the Service in any way that interferes with its operation or the experience of other users
- Upload content that is illegal, infringing, defamatory, obscene, or harmful
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
7.3 — Canvas and Export Restrictions
The canvas workspace allows you to arrange both Motion Index library content and your own uploaded content in a spatial layout. Library content (thumbnails and embeds from the Motion Index library) is available for use within the platform only. When exporting projects (PDF, HTML, image), library content will be excluded or replaced with reference placeholders. Your own uploaded content is fully exportable.
7.4 — Enforcement
We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice, depending on the severity of the violation. Where practical, we will attempt to notify you and give you an opportunity to correct the issue before taking action.
8. Rights Holder Takedown Process
Motion Index respects the intellectual property of content creators. If you are a rights holder and believe your work is being referenced in a way you object to, we will respond promptly.
8.1 — How to Request Removal

- Identification of the copyrighted work(s) affected
- The specific URL(s) or content within Motion Index you want removed
- Your contact information
- A statement that you are the rights holder or authorised to act on their behalf
8.2 — Our Response
Upon receiving a valid takedown request, we will:
- Remove or disable access to the identified thumbnails and/or embeds promptly, typically within 2 business days
- Notify you when the removal is complete
- Ensure the content is not re-indexed without the rights holder's consent
8.3 — DMCA Compliance
For users and rights holders in the United States, we comply with the notice-and-takedown procedures of the Digital Millennium Copyright Act (DMCA). Our designated agent for receiving DMCA notices is:

8.4 — Counter-Notification
If you believe content was removed in error, you may submit a counter-notification with an explanation. We will review and respond in accordance with applicable law.
8.5 — Repeat Infringement
Consistent with applicable law, we reserve the right to terminate accounts of users who repeatedly violate these Terms or who redistribute content from the Service.
9. Collaboration and Shared Content
9.1 — Projects and Collaboration
When you invite collaborators to a project, you control their access level (owner, editor, viewer). You are responsible for managing who has access to your projects.
9.2 — Shared Review Links
When you share a project via a review link, recipients may be required to verify their identity (email verification) before viewing. Shared views are subject to the same content restrictions as the platform — library content is visible within the platform context but is not downloadable or extractable by recipients.
9.3 — Responsibility for Shared Content
You are responsible for ensuring that content you share (including user-uploaded files in projects) does not infringe on third-party rights. Motion Index is not responsible for user-uploaded content shared through collaboration features.
10. Third-Party Services and Platforms
10.1 — YouTube and Vimeo
Videos embedded in Motion Index are served by YouTube and Vimeo and are subject to those platforms' terms of service. If a video is removed from its originating platform or if the creator changes its embed or privacy settings, the corresponding content will become unavailable within Motion Index.
10.2 — Stripe
Payment processing is handled by Stripe. Your use of Stripe's services is subject to the Stripe Services Agreement. Payment card data is handled entirely by Stripe and is never stored on Motion Index servers.
10.3 — Other Services
The Service uses additional third-party providers for infrastructure, email, error monitoring, and search functionality. Details on data shared with these services are available in our Privacy Policy.
11. Service Availability and Limitations
11.1 — Availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Enterprise customers may be eligible for separate service level agreements.
11.2 — Content Availability
The Motion Index library is curated and changes over time. Videos may be added, removed, or become unavailable (for example, if a creator removes their video from YouTube or Vimeo, or if a rights holder requests removal). We do not guarantee that any specific content will remain available in the library.
11.3 — Feature Changes
We may add, modify, or remove features of the Service at any time. We will provide reasonable notice for changes that materially affect paid functionality.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- Motion Index shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
- We are not responsible for the accuracy, legality, or availability of third-party video content accessible through the Service.
- Your use of information or inspiration derived from content viewed through the Service is at your own discretion and risk.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.
12.1 — Indemnification
You agree to indemnify and hold harmless Motion Index from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the Service, or your infringement of any third-party rights.
13. Account Termination and Data
13.1 — By You
You may delete your account at any time. Upon deletion:
- Your personal data will be deleted in accordance with our Privacy Policy
- Your collections, projects, and uploaded content will be permanently removed
- Any active subscription will be cancelled (refund eligibility per Section 4.4 applies)
13.2 — By Us
We may suspend or terminate your account if you violate these Terms or if required by law. Where possible, we will provide notice and an opportunity to export your data before termination.
13.3 — After Termination
Upon account termination, your license to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.
14. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice within the Service at least 14 days before the changes take effect.
Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree with the updated Terms, you may close your account.
15. Governing Law and Disputes
These Terms are governed by the laws of Norway. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Norway.
For users located in the European Economic Area, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.
